Above Ground Pool Regulations
Above ground pools are subject to the same Queensland safety laws as in-ground pools. Here's everything you need to know about fencing, barriers, registration, and compliance. 🏊♂️
The Short Answer
Does Your Pool Need a Compliant Fence?
✅ Yes — If It Meets These Thresholds
Under the Building Act 1975, all swimming pools in Queensland — including above ground pools, portable pools, and spas — must have a compliant safety barrier if they meet any one or more of the following:
- Can hold more than 300mm (30cm) of water
- Have a volume exceeding 2,000 litres
- Have a filtration or pumping system
🚫 Exempt — Small Wading Pools Only
Queensland's pool safety laws generally do not apply to portable wading pools that:
- Cannot be filled beyond 300mm of water
- Has a maximum volume of 2,000 litres
- Has no filtration or pumping system
Even exempt pools should never be left unattended with young children.
Barrier Standards
Fencing & Barrier Requirements
Above ground pools have unique barrier considerations. The pool wall itself may qualify as a barrier — but only under specific conditions.
Minimum Barrier Height
The pool wall or surrounding fence must be at least 1,200mm above finished ground level on the outside.
Pool Walls as Barriers
For above ground pools, the walls of the pool may serve as the barrier — provided they meet the 1,200mm height requirement and have no external bracing struts or footholds that could help a child climb.
Ladder & Access Point Fencing
Even when the pool walls qualify as a barrier, you still need compliant fencing with a self-closing, self-latching gate around the ladder or any other entry point to the pool.
Non-Climbable Zone (NCZ)
All climbable objects — including pumps, filters, associated piping, garden furniture, and retaining walls — must be positioned at least 900mm away from the outside of the pool barrier (or 1,200mm from the pool wall if it acts as the barrier).
Ground Clearance
The maximum gap between the bottom of any barrier and the finished ground level must not exceed 100mm to prevent young children from crawling underneath.
Gate Requirements
- Gates must open outward (away from the pool area) and be self-closing and self-latching from every position.
- The gate latch must be at least 1,500mm above ground level, or be shielded and positioned on the inside so a child cannot reach it.
- Gate hinges thicker than 10mm must be spaced at least 900mm apart — or the lower hinge must have a non-climbable safety cap fitted.
- The gate and latch must function correctly every time — a gate that sticks open or fails to latch is an automatic non-compliance.
Pool Registration 📋
All regulated pools in Queensland must be listed on the Queensland Pool Safety Register — and that includes above ground pools, portable pools, and spas that meet the thresholds above.
You can register your pool or check if it's already listed via the QBCC's online register. Registration is free and must be completed before a pool safety certificate can be issued.

If your above ground pool is positioned close to a house or another building, the same door and window rules apply as for in-ground pools:
- No direct access through a door from the house into the pool area without a compliant barrier and gate in between.
- Any window opening onto the pool area must not open more than 100mm, or must have a compliant security screen fitted.
Your Job as the Owner
Owner Responsibilities
Owning an above ground pool in Queensland comes with the same legal obligations as any other regulated pool. Here's what's on your plate. 📋
Register the Pool
Get it on the Queensland Pool Safety Register through the QBCC. It's free, takes a few minutes online, and skipping it can land you a fine.
Install a Compliant Barrier
Whether that's the pool wall acting as the barrier, a separate fence, or a combination — it has to meet the pool barrier safety standard from day one.
Keep It Maintained
A barrier that was compliant when installed won't stay that way forever. Hinges loosen, latches wear out, gardens grow. Ongoing upkeep is your responsibility.
Keep Gates Closed
Self-closing gates only work if they're not propped open with a brick, a bin, or a pot plant. Treat the gate as if a toddler could wander up at any moment — because they can.
Clear the Surrounds
Anything climbable inside the Non-Climbable Zone is a hazard. Move the BBQ, the kid's chair, the planter box and the trampoline well away from the barrier.
Get a Pool Safety Certificate
Leasing a property with a regulated pool? You'll need a current pool safety certificate issued by a licensed inspector before tenants move in.
Balconies & CPR Signage 🪧
Two things people regularly miss with above ground pools positioned near the house or a deck:
- Balconies & decks — if any balcony or raised deck sits over the pool area, or comes within 900mm of the barrier, the balustrade has to comply with the pool safety standard. A standard handrail won't cut it.
- CPR sign — every regulated pool needs a current, compliant CPR sign mounted on the barrier or somewhere clearly visible from the pool. Old or faded signs are a non-conformity.
What Happens If You Don't Comply?
Council has the authority to inspect any backyard pool — including above ground setups — and they're well within their rights to issue penalties when the barrier doesn't meet the standard.
You can also cop a fine for failing to register the pool with QBCC, or for selling/leasing a property without a valid safety certificate.
Far more importantly though, the rules exist because a child can drown in a few seconds in surprisingly shallow water. Compliance isn't paperwork — it's prevention.
Inspector G's Tips
Make Your Above Ground Pool Safer (and Pass First Time)
Most above ground pool fails I see come down to a handful of recurring issues. Sort these out before booking your inspection and you'll save yourself a reinspection fee. 💪
- Level the ground around the pool so the barrier (or pool wall) sits at a true 1,200mm minimum the whole way around — soft soil and slopes are a common gotcha.
- Service the gate hinges and latch regularly. A self-closing gate that drags or fails to latch is the single most common reason for a non-conformity notice.
- Move climbable objects — pumps, filters, BBQs, pot plants, the kids' Cosco chair — at least 900mm away from the outside of the barrier (1,200mm if the pool wall is the barrier).
- Keep trees, shrubs and any landscaping inside the NCZ trimmed back. Vegetation that becomes a foothold isn't compliant.
- Add safety winders or restrictors to any window opening into the pool area so it can't open more than 100mm — or fit a fixed security screen.
- If you've got louvre windows nearby, check the spacing — anything wider than 100mm between blades creates risk and won't pass.
- Don't rely on the pool cover as a 'safety' feature. Covers are not barriers under the standard, no matter how heavy-duty they are.
